These Terms of Service ("Terms") form a binding agreement between you and the applying.sucks service ("Applying.Sucks", "we", "us", "our"), operated as a sole trader (autónomo) by Marc Amorós, NIF ES48042888M, Josep Irla 117, 08195 Sant Cugat del Vallès, Spain.
By creating an account, accessing, or using the applying.sucks website, the authenticated app at app.applying.sucks, our APIs, or any feature we make available (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Applying.Sucks is a job-application automation platform. It uses artificial intelligence and a browser agent to read job postings, generate application answers from your profile, fill out application forms, and submit applications to employers and third-party job platforms on your behalf. The Service includes profile management, job discovery, scheduling, application logging, and billing features. It does not recruit you, represent employers, or guarantee any employment outcome.
You must be at least 18 years old and legally able to enter into a contract to use the Service. You agree to provide accurate, current, and complete information when you register, to keep it up to date, and to be responsible for all activity under your account. You are responsible for safeguarding your login credentials and any credentials you store in your Vault, and for notifying us promptly at hello@applying.sucks if you suspect unauthorized access. Each account is personal to you; do not share or transfer it without our prior written consent.
You retain all rights in the resume, profile data, preferences, credentials, and other content you submit ("Your Content"). You grant Applying.Sucks a limited, worldwide, royalty-free license to host, store, reproduce, adapt, transmit, and display Your Content solely as necessary to provide and secure the Service, including submitting applications on your behalf.
By enabling the autopilot or any automated application feature, you appoint Applying.Sucks as your limited agent, solely to browse job listings, generate draft application answers from Your Content, fill out application forms, and submit those applications to employers and job platforms that you have authorized. You can revoke this authorization at any time by disabling the feature or deleting your account. You are solely responsible for the content of any application submitted through the Service.
You agree not to, and not to allow any third party to:
The Service interacts with third-party job boards, applicant tracking systems, and employer websites ("Third-Party Platforms") at your direction. We are not affiliated with, endorsed by, or responsible for any Third-Party Platform, and we have no control over their availability, content, or policies. Your use of the Service in connection with a Third-Party Platform is subject to that platform's own terms, and you are responsible for complying with them. Third-Party Platforms may detect, restrict, suspend, or terminate automated activity, including activity initiated through the Service. We are not liable for any consequence arising from your use of, or inability to use, a Third-Party Platform through the Service.
The Service uses AI models to generate draft application answers and cover letters from Your Content. AI outputs are probabilistic and may contain errors, inaccuracies, or content that does not reflect your intent. You are solely responsible for reviewing and approving, whether before or by means of your configured rules, any content submitted on your behalf. We do not warrant that AI-generated content will be correct, complete, fit for a particular purpose, or free of bias. Outputs may be similar to outputs generated for other users; we do not claim ownership of AI-generated outputs on your behalf beyond the license you grant us above.
The Service includes a free tier and several paid plans. Plan features, daily application limits, and prices are shown on the pricing page and on the in-app subscription screen.
New users who complete phone verification and onboarding receive a three (3) day free trial of the autopilot, without providing payment details. The trial is a limited-time free tier, not a pre-paid subscription. At the end of the three days the autopilot is automatically disabled; you keep access to your account and can upgrade to a paid plan at any time. Because no payment method is collected during the trial, it does not auto-convert into a paid subscription.
When you choose a paid plan and complete checkout, you expressly authorize us (through our payment processor Stripe) to charge the payment method on file for the applicable fees, taxes, and any overages, on a recurring monthly basis, until you cancel. Billing terms, including price and renewal period, are disclosed on the checkout screen.
If you are an EU consumer, you have a right under Spanish and EU law to withdraw from a paid subscription within 14 days of purchase. By starting to use the paid features during that period, you expressly consent to us beginning performance before the 14-day period expires and you acknowledge that you will lose the right of withdrawal once we have fully performed. To exercise the right of withdrawal within the 14 days, email hello@applying.sucks.
Applying.Sucks and its licensors own the Service, including all software, models, designs, text, graphics, and logos. We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purposes. All rights not expressly granted to you are reserved. The Applying.Sucks name and logo are our trademarks; you may not use them without our prior written consent.
If you provide us with suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and commercialize that feedback without obligation or compensation to you.
We may make beta, preview, or experimental features available to you. They are provided "as is", may change or be discontinued at any time, and may contain bugs. We may collect additional information about your use of these features to improve them. Your use of beta features is voluntary.
We may suspend, restrict, or terminate your access to the Service, in whole or in part, if we reasonably believe that you have breached these Terms, that your use poses a security or legal risk, or that we are required to do so by law. Where practical and permitted, we will notify you. You can terminate these Terms at any time by deleting your account in settings. On termination, your license to use the Service ends, and we will delete Your Content within 30 days, except where retention is required by law or necessary to resolve a dispute, enforce these Terms, or comply with our legitimate business needs.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or secure, that any particular application will be submitted, received, reviewed, or accepted, or that the Service will result in any interview, offer, or employment outcome.
To the fullest extent permitted by law, Applying.Sucks and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunities, or job opportunities, arising out of or in connection with the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages. In no event will our aggregate liability for all claims relating to the Service exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred euros (€100).
You agree to indemnify, defend, and hold harmless Applying.Sucks and its affiliates, officers, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to (a) Your Content, (b) your use of the Service in violation of these Terms or any applicable law, (c) your violation of the rights of a third party, including any Third-Party Platform, or (d) any misrepresentation or false statement you submit through the Service.
Informal resolution first. Before filing any formal claim, contact us at hello@applying.sucks and attempt in good faith to resolve the dispute for at least 30 days.
Governing law. These Terms are governed by the laws of Spain, without regard to its conflict-of-law principles.
Venue. Any dispute not resolved informally will be submitted to the exclusive jurisdiction of the courts of the city of Madrid, Spain, subject to any non-waivable statutory protection available to consumers in their place of residence. EU consumers retain the right to bring proceedings in the courts of the Member State in which they live.
Online Dispute Resolution. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Exceptions. Nothing in this section prevents either party from seeking injunctive or equitable relief to protect intellectual property or confidentiality, or from exercising any non-waivable statutory right.
We may update these Terms. If changes are material we will notify you by email or through the Service and update the "Last updated" date. Changes take effect 30 days after posting, or sooner if required to comply with law. These Terms, together with our Privacy Policy and any order form or plan you accept, are the entire agreement between us. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. Notices to you may be sent by email or through the Service; notices to us must be sent to hello@applying.sucks. Neither party is liable for any delay or failure due to events beyond its reasonable control.
